・Abstract:

What does law really do to peoples’ lives?  How does it really evolve?
In this presentation, the speaker discussed research that takes a law and society approach in analyzing the process and outcome of litigation with significant social impact.
The seminar began with an introduction to this approach in contrast to the analysis of doctrinal law, which is symbolized by the phrase “law in books v. law in action
Two case studies were then presented—one regarding the successful litigation over the nationality of Japanese Filipino Children born outside of marriage; and the other regarding the continued litigation over the “one person one vote” rule, which in essence is about distribution of political power between urban and rural areas within Japan.
The latter especially is an ongoing Kakenhi project. During the seminar, the speaker welcomed input on potential sources and data that could contribute to a deeper analysis of the real-life impact of such litigation.
