・Abstract:

This presentation, part of my research on energy transitions litigation, investigates the trajectory and impact of nuclear mobilization in Japan, with a particular focus on the Rokkasho site in Aomori Prefecture. The study aims to understand the significance of long-term mobilization and strategic litigation in shaping risk prevention and governance within environmental policy, as well as ensuring accountability. It examines the movement’s scale and temporality by drawing parallels with international sites such as La Hague (France) and Sellafield (UK), and national cases including Monju, Fukushima, and Noto Hantō. This analysis highlights how lawyers have evolved their litigation strategies across different scales and timeframes to address emerging risks and incorporate innovative legal arguments. Positioned within the broader context of environmental justice, the research demonstrates how sustained legal efforts, despite often being unsuccessful, have fostered the development of legal expertise and maintained the movement’s momentum over four decades.
