概要 Abstract :
The survival of international organizations (IOs) sometimes depends on whether international law evolves quickly enough to keep up with changing global conditions and member preferences. One way in which the law can evolve is through the decisions of international adjudicators. Adjudicators can shift international law’s meaning as they reinterpret state obligations over time. When adjudicators successfully adapt the law, they can promote compliance. However, this process is often gradual and may not happen quickly enough. We analyze these dynamics at the World Trade Organization (WTO). We present both large-N and case study evidence of how WTO adjudicators try to promote compliance. We find that adapting legal precedent—specifically, narrowing the scope of previous rulings—can lessen the burden placed on dispute respondents and encourage compliance. Of course, this adaptation does not happen in every dispute. Hence, the WTO illustrates the tension that endangers IO longevity. Our findings lend insight into the lifecycle of IOs as well as the ways in which international law evolves under the pressure of state resistance.
