【Abstract】
Professor Jake Sherkow of the University of Illinois College of Law will deliver a lecture on the fundamentals of indirect patent infringement in U.S. patent law, with a particular focus on the legal principles of induced infringement under 35 U.S.C. § 271(b). Drawing on recent litigation and legal doctrine, most notably the debate over “infringement by label” highlighted in the Hikma v. Amarin case currently before the Supreme Court, he will critically examine whether current case law could expand liability for induced infringement beyond the existing elements, such as active inducement and causation. Furthermore, this lecture will discuss broader issues, including the proper boundaries of indirect infringement and the role regulatory contexts play in shaping liability, and will also offer insights into the discussions surrounding the scope and structure of indirect infringement in Japan.
