法学学術院とは？

早稲田大学法学学術院は、法学に関わる研究と教育を担う組織として、2004年に導入された学術院制度のもとで設置されました。現在では、法学部・法学研究科・法科大学院（ロースクール）・比較法研究所・法務教育研究センターの五つの機関によって構成されています。

法学学術院という組織の歴史は比較的新しいものですが、その基盤となる早稲田法学の歩みは、1882年の東京専門学校創設時に設置された法律学科にまで遡ります。以来140年以上にわたり、早稲田大学は法学の研究と教育の発展に努め、多くの研究者・法曹・公務員・企業人をはじめ、社会のさまざまな分野で活躍する人材を送り出してきました。法学学術院は、この長い歴史と伝統を受け継ぎながら、現代における法学の発展を担う組織です。

法学は、人と社会のあり方を探究する学問です。社会には、さまざまな価値観や利害、文化的背景をもつ人々が存在します。その中で、異なる立場を理解し、互いの主張に耳を傾けながら、より良い社会のあり方を考えることは、法学の重要な使命です。

今日、私たちを取り巻く社会環境は大きく変化しています。AIをはじめとする科学技術の発展、グローバル化の進展、国際秩序の変容、環境問題など、現代社会が直面する課題はますます複雑化しています。このような課題に向き合うためには、既存の制度や理論を正確に理解するだけではなく、多様な視点から問題を捉え、新たな知見を創出する研究が不可欠です。法学学術院は、そのような知的探究の拠点として、社会に貢献する役割を果たしていかなければなりません。

法学学術院を構成する各機関は、それぞれ固有の使命と特色を有しています。法学部は、幅広い視野と確かな専門性を備えた人材を育成する場であり、法学研究科は、次代を担う研究者の養成と法学研究の深化を担っています。法科大学院は、高度な専門能力を備えた法曹の養成に取り組んでいます。また、比較法研究所は、長年にわたり国内外の研究者との共同研究を推進し、法務教育研究センターは、法学教育と法曹養成に関するさまざまな活動を支えています。

これらそれぞれの機関が一つの学術院として活動する意義は、たんに組織を統合することにあるのではありません。研究と教育、理論と実践、異なる専門分野や研究方法を結びつけることで、法学の可能性をさらに広げることがその目的です。異なる関心や視点をもつ研究者が互いに刺激を与え合い、自由に議論を重ねることによって、新たな知が生まれます。そのような知的交流を支える環境を整えることも、法学学術院の重要な使命です。

また、研究と教育は相互に支え合う関係にあります。最先端の研究成果が教育の場に還元され、学部生や大学院生との対話を通じて新たな研究課題が生まれます。そのような循環こそが、大学における学問の発展を支えているのです。法学学術院は、学部から大学院、研究所に至るまでの連携をさらに深め、研究と教育の双方において高い水準を維持し、より発展させていきます。

早稲田大学には、自由な精神のもとで自ら問いを立て、既存の枠組みにとらわれることなく新しい知を切り拓いてきた伝統があります。法学学術院もまた、その精神を受け継ぎ、多様な専門性をもつ研究者が協働しながら、国内外の学術界をリードする研究成果を引き続き生み出していきます。

法学学術院は、140年以上にわたる早稲田法学の伝統を礎としながら、変化する社会の要請に応える新たな法学の創造に挑戦していきます。そして、研究と教育を通じて、人々がより良く共に生きる社会の形成に貢献することができるよう、教職員一同、不断の努力を続けていきます。

What is the Faculty of Law?

The Waseda University Faculty of Law was established under the Faculty System introduced in 2004 as an institution responsible for legal research and education. Today, it comprises the following five institutions: the School of Law, the Graduate School of Law, the Waseda Law School, the Institute of Comparative Law, and the Center for Professional Legal Education and Research.

The Faculty of Law is a relatively new institution. However, the history of legal education at Waseda University, which forms the foundation of the Faculty, dates back to the Department of Law established in 1882 when the Tokyo Senmon Gakko was established. For more than 140 years, Waseda University has been dedicated to promoting the development of legal research and education, producing countless individuals who have played a significant role in various sectors of society such as researchers, legal professionals, civil servants, and business leaders. The Faculty of Law, which inherits this long history and tradition, serves as an institution responsible for advancing the study of law in modern times.

The study of law is a discipline that explores the realities of people and society. Because our society consists of people with diverse values, interests, and cultural backgrounds, a key mission of the study of law is to encourage you to recognize and appreciate other people’s perspectives, keep an open mind about their arguments, and contemplate how to create a better society.

Today, our social environment is undergoing significant transformation: the challenges facing modern society, such as technological innovations including AI, the rapid pace of globalization, changes in the international order, and environmental concerns, are becoming increasingly complex. To address these challenges, we must develop an accurate understanding of existing systems and theories, as well as engage in research that examines the issues from many different viewpoints to acquire new insights. As a center for intellectual pursuit, the Faculty of Law should continue to play a contributing role in society.

Each institution of the Faculty of Law has its own unique mission and distinctive features. The School of Law is a place for developing individuals who possess both broader perspectives and strong specialist expertise, while the Graduate School of Law is responsible for educating the next generation of researchers and advancing legal research. The Waseda Law School is dedicated to training legal professionals with highly specialized skills. The Institute of Comparative Law has promoted collaborative research with researchers from Japan and around the world for many years, and the Center for Professional Legal Education and Research supports a broad range of activities related to legal education and the development of legal professionals.

The significance of each of these institutions working together as the Faculty of Law is not just about organizational integration; the purpose is to further expand the possibilities arising from the study of law by connecting research with education, theory with practice, and various fields of specialization with diverse research methodologies. New knowledge emerges when researchers with different interests and viewpoints intellectually stimulate each other and repeatedly engage in free and open discussion, so providing an environment that supports such intellectual interactions is another important mission of the Faculty of Law.

In addition, research and education complement each other. The findings of cutting-edge research are integrated into teaching, and new research themes emerge through dialog with undergraduate and graduate students. This cycle is exactly what sustains the progress of learning at the University. The Faculty of Law seeks to strengthen collaboration throughout the University, from undergraduate and graduate schools to research institutes while maintaining high standards of research and education for further growth.

Waseda University has upheld a tradition of inspiring students to develop their own questions with a spirit of freedom and openness, encouraging them to cultivate new knowledge beyond the confines of existing frameworks. The Faculty of Law, too, shares this spirit and through collaboration among researchers from diverse fields of expertise, it continues to produce research findings that lead the academic community both in Japan and around the world.

Drawing on the long-standing tradition of legal education at Waseda University that spans more than 140 years, we at the Faculty of Law will rise to the challenge of creating a new approach to legal education that meets the evolving demands of society. Through research and education, all of our faculty and staff remain committed to helping to build a society where people can coexist in better and more harmonious ways.
