Legal Policy on Wetland Conservation to Ensure the Effectiveness of the Australia-Japan Migratory Bird Conservation Agreement

Overview

More than 40 years have passed since the adoption of the Convention on Wetlands of International Importance Especially as Waterfowl Habitat (Ramsar Convention), an international agreement on wetland conservation. However, even today, the decline and degradation of wetlands has not been sufficiently halted. In addition, the protection of migratory birds that use wetlands as their habitat remains fragmented.

This study focuses on such a current situation and clarifies the challenges faced by the legal systems for wetland conservation and migratory bird protection from the three perspectives , “Japanese environmental law,” “Australian environmental law,” and “International environmental law.

Furthermore, this study adds the perspective of ensuring the effectiveness of the Japan-Australia Migratory Bird Conservation Agreement, and through a comparative study of the legal policies for wetland and migratory bird conservation in Japan and Australia, clarifies what is required of the legal policies for wetland and migratory bird conservation in Japan in the future.
