Reshaping legal systems for intellectual property in the era of globalization – The establishment and development of the “Preparatory Organization for the Establishment of the Waseda University Intellectual Property Integrated Research Institute,” an integrated research institute for the humanities and the sciences

Overview of research

Legal systems for intellectual property have thus far been established to function as an important incentive for the development of technology and the creation of diverse cultures. The legal system model for intellectual property that currently exists in the world was formed in modern Europe and the Americas, and has developed alongside systemic harmonization through international laws. However, increasing globalization with respect to inventors and inventions, coupled with global changes in the modes of information distribution, have given rise to numerous intractable issues, and the incentive function embedded within the existing legal system model for intellectual property is becoming increasingly dysfunctional.

In order to tackle these problems, there is a need to take a multi-faceted approach that goes beyond the boundaries of traditional legal studies, even as the field continues to develop in a global manner in ways that include the disclosure of foreign information for public use. In order to raise concrete proposals for the reshaping of legal systems for intellectual property to resolve these issues, this research involves the creation of a base for the dissemination of English-language law cases on intellectual property based on cooperation with American, European, and Asian researchers with established databases of cases in English. At the same time, the research group will utilize Wasedafs strengths in its position as a university to study research approaches for extracting and solving issues facing inventors and inventions, and carry out separate and integrated academic research in accordance with the development of legal studies and globalization of inventors and inventions that have arisen as a result of the former.

  1. Policy proposals concerning important Japanese and foreign policy issues: Utilizing the results of research integrating the humanities and the sciences, and further, with a focus on the perspective of building up a legal and enforcement system that goes beyond differences in common and continental laws, conduct investigative research on concrete policy issues in Japan and abroad (research pertaining to the creation of an intellectual property system corresponding with the digital and networked age, systems dealing with conflicts arising from patents and copyrights, appropriate protection for intellectual property rights in other countries, protection of brands in Japan, etc.), and propose opinions as a space for the formulation of policies.
  2. Establishment of an international academic society, and creation of an international research base for intellectual property, integrating the humanities and the sciences, and aimed at disseminating global English-language information on intellectual property: With the aim of creating a base for the dissemination of global English-language information on intellectual property through the international researcher organization (Asia, the Americas, and Europe) that comes under the Research Center for the Legal System of Intellectual Property in Waseda Universityfs Global COE program, along with legal studies, and taking into consideration cooperative systems with Waseda researchers engaged in fields such as engineering and economics, we plan to establish an integrated (humanities and sciences) Waseda University Intellectual Property Research Institute, as well as an international academic society for the study of intellectual property.
