Abstract:<\/span><\/h5>\n

The 1998 Human Rights Act in the United Kingdom is the legislation for domestically implementing the European Convention on Human Rights. This symposium clarifies how both British law and the European Convention on Human Rights have interacted with each other as a result of the enactment and implementation of this Human Rights Act.<\/p>\n

Changes that occurred on the side of British law will be discussed, including de facto<\/em>\u00a0restrictions on the legislative power of Parliament, acceptance of and resistance to European Court of Human Rights precedents by British courts, the unique development of the common law, and the development of new constitutional theories on human rights law.<\/p>\n

Changes that have occurred on the part of the European Convention on Human Rights will be examined, including the “judicial dialogue” between the British courts (and the courts of other member states) and the European Court of Human Rights, amendments to the preamble of the European Convention on Human Rights in the Council of Europe and amendments to the Rules of Court in the European Court of Human Rights. The in-person presentation will be followed by a panel discussion and discussion with the audience.<\/p>\n
