\nIn Europe and the U.S., recent studies have been showing that covenants stipulating post-retirement non-competition obligations (the obligation not to work for a company that competes with the employer or to open one’s own business) play a major role in buyer (employer) monopoly in the labour market. Inspired by these studies, the nature of non-competition covenants has become an issue from the perspective of both labour law and competition law.<\/p>\n
From the viewpoint of what role labour law can play in regulating buyer monopoly in the labour market, this lecture reviews the common law “Doctrine of Restraint of Trade,” which forms part of labour law on post-employment non-competition obligations in the United Kingdom.<\/p>\n
