Exploring Foreign Laws as a Part of Japanese Law

Term 2011-2012
Japanese law is often characterized as "Hybrid law" since it has been developed through the interaction of the Japanese native law and some foreign laws. Considering its hybrid nature, there seem two different approaches in examining Japanese law. One is exploring Japanese law focusing on its aspect as a native law and the other is exploring foreign laws which have become part of Japanese law. When we take the latter approach, we will study Japanese law from the perspective of foreign laws, analyzing how the foreign laws have been modified and eventually settled in Japanese law.
The recent research projects at the Institute of Comparative Law, including our fifty-year anniversary research project and other projects supported by the governmental Grants-in-Aid for Scientific Research, have been taking the former approach to Japanese law, focusing on its nature as a native law. With the accomplishments of those projects in mind, we now give our attention to the other aspect of Japanese law. For academic year 2011/2012, we will conduct our new research project entitled "Exploring Foreign Laws as a Part of Japanese Law."
